IS IT LEGAL TO HAVE A TREE TOPPED IF PIGEONS ARE NESTING IN IT?

my parents our having our tree topped outside my house- the tree itself is now slightly taller then the house. (i live in the countryside in the middle of nowhere) i want to save the tree as it is Beautiful and looks nice as well as the fact that there are 2 pigeons nesting in it.
